Commissions apply only to eligible completed referrals. The complete terms below control participation, validation, payment and use of BTECH intellectual property.
1. Agreement, acceptance and approval
These Affiliate Program Terms (“Agreement”) govern participation in the BTECH Radios affiliate program (“Program”). “Affiliate” means an approved individual or entity promoting BTECH products through an authorized referral link. “BTECH,” “Affiliate Manager,” “we,” “us” and “our” refer to B-TECH Distribution Inc. and BaoFengTech.com.
Submitting an application does not guarantee approval. BTECH may approve or reject an application at its discretion. Participation begins when an application is accepted and the Affiliate accepts this Agreement electronically.
The relationship is non-exclusive and does not create employment, partnership, agency, franchise or authority to bind BTECH.
2. Commissions and payment
Published commission tiers are based on eligible completed purchase referrals during a calendar month. Counts reset on the first day of each month.
Affiliates who consistently exceed 200 eligible monthly referrals may be considered for a separately negotiated rate. No custom rate applies unless confirmed by BTECH in writing.
Eligibility and validation
- Commissions are paid monthly for eligible transactions that remain completed and valid through the applicable validation period.
- Refunded, canceled, charged-back, fraudulent, duplicated, misattributed or otherwise ineligible transactions do not earn commission.
- Self-referrals are not permitted.
- BTECH may withhold or reverse commission connected to a violation, fraud, tracking manipulation or an ineligible transaction.
Tracking systems can be affected by browser settings, customer choices, technical interruptions or other conditions. BTECH does not guarantee that every visit or transaction will be attributed.
3. Promotion and marketing rules
Affiliates must make accurate, supportable claims and comply with applicable advertising, privacy, consumer-protection, anti-spam and endorsement-disclosure requirements.
- Clearly disclose the affiliate relationship near the recommendation or link.
- Do not make false safety, range, power, certification, compatibility, warranty or product-performance claims.
- Do not send unsolicited bulk messages, promote unlawful activity or present a site or account as an official BTECH channel.
- Do not offer unauthorized rebates, kickbacks, incentives, coupons or discounts funded from commission.
- Do not use pop-ups, pop-unders, iframes, cookie stuffing, forced redirects or other methods that place tracking without a genuine customer referral and appropriate consent.
Paid search and coupon sites
Paid-search or pay-per-click bidding is not allowed without prior written permission. Affiliates may not bid on BTECH trademarks, confusing misspellings or terms that imply an official BTECH site unless expressly authorized.
Coupon or deal content must identify the actual offer before setting an affiliate cookie. Unauthorized, expired or misleading coupon promotions may result in removal from the Program.
4. BTECH brand and content use
While the account remains approved, BTECH grants a limited, non-exclusive, non-transferable, revocable license to use authorized BTECH trademarks, links and marketing materials only to promote the Program.
- Follow current brand, product and legal-use guidance.
- Do not alter marks in a misleading way or register confusing domains, accounts, business names or advertising identities.
- Do not imply sponsorship, employment, exclusivity or authority beyond approved affiliate status.
- Stop using BTECH intellectual property when participation ends or when requested.
Affiliate-created content remains the Affiliate’s responsibility. BTECH approval of an account does not approve every individual statement or promotion.
5. Confidentiality and data protection
Non-public product, commercial, customer, technical or Program information must be kept confidential and used only for authorized participation.
Affiliates must comply with applicable privacy and data-protection law, maintain reasonable security and collect only information they are legally permitted to collect. An Affiliate may not receive or use BTECH customer data except as expressly authorized in writing.
6. Suspension, termination and changes
BTECH may suspend or terminate participation at its discretion, including for misleading claims, spam, unlawful promotion, undisclosed endorsements, intellectual-property violations, self-referrals, suspected fraud, attribution manipulation or other breach of this Agreement.
An Affiliate may leave the Program at any time. On termination, promotional use of BTECH materials and marks must stop. Valid unpaid commissions remain subject to final review, adjustment, refund and chargeback rules.
BTECH may update the Program or this Agreement. Continued participation after updated terms take effect constitutes acceptance. If an Affiliate does not accept an update, the Affiliate must stop participating.
7. Legal terms
Service availability and liability
The Program and tracking are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, BTECH is not liable for indirect, incidental, special or consequential loss, including lost commission caused by tracking interruption, database loss, service outage or third-party conduct.
Indemnification
The Affiliate agrees to defend, indemnify and hold harmless BTECH and its affiliates from claims, damages, liabilities, costs and reasonable expenses arising from the Affiliate’s promotion, legal violation, breach of this Agreement or infringement of another party’s rights.
Force majeure
Neither party is responsible for failure or delay caused by circumstances beyond reasonable control.
Electronic agreement and governing law
Acceptance during application or continued participation constitutes an electronic signature. This Agreement is governed by South Dakota law. Disputes are subject to courts with appropriate jurisdiction in Kingsbury County, South Dakota.
If a provision is held invalid or unenforceable, the remaining provisions continue in effect. This Agreement and any written custom terms form the complete agreement governing Program participation.
